Facts and Grounds of Petition
1 Against Magisterium of His Eminence Nicholas Cardinal Cheong.
On Dec 10, 2010. certain priests (members of so-called The Catholic Priests¡¯ Association for Justice – This group is an illegal organization, within the Korean Catholic Church, which has persisted in violation of Codex IurisCanonici can.300. can.312) have mounted a challenge to His Eminence Nicholas Cardinal Cheong and called his righteous and just teaching(evidence 1.), with regard to the Restoration of Four Major Rivers(the Korean Public Works), a deceitful explanation(or sophistry).
They have vilified and jeered at him, by way of questioning, ¡°whether he had sided with the Korean government because of his hidden weakness or not.¡±
They have insulted him by distortion and denunciation that he had stirred up hatred against North Korea.(Evidence 2. 3. 6. 7. 9. 10.)
On Dec 13, 2010.they arranged a press interview, revolted against Superior, overturned the Church order and demanded an apology and resignation of His Eminence Cardinal Cheong.(Evidence 4. 5. 9. 10.)

We also refer the offences, for ascertainment and punishment, of certain priests who have written such illegal public statements or consented to them, behind the name shield of so-called CPAJ.(Evidence 2.)

3 The offenders stand for erroneous causes and grounds:
They allege that Cardinal Cheong has done wrong by his expressionand intention different from the statement of Catholic Bishops¡¯ Conference of Korea.(Evidence 1. 2. 3. 4. 5.)
The statement of CCK, dated Mar 12, 2010. alleged that ¡°the Korean government had pushed and hurried up Public Works for Restoration of Four Major Rivers without citizens¡¯ consensus and had outwitted and evaded the law and the procedure.¡±
The statement quoted a part of ¡°Article 48 of Charitas in Veritate of the theSupreme Pontiff Benedict XVI¡±;¡°The environment is God's gift to everyone, and in our use of it we have a responsibility towards the poor, towards future generations and towards humanity as a whole.¡±(Evidence 11.)
It is doubtful that the subject matter of RFMR had been officially noticed in advance, formally introduced and discussed, on the agenda, at CCK of March 2010.
And, in its contents, the statement has untrue main parts.
The Public Works of RFMR are being implemented, with the background of Korean citizens¡¯ popular support, according to the Korean Law and the appropriate legal procedure, to improve the environment(Evidence 23-31).
The Courts of the Republic of Korea dismissed all the claims of people who had opposed and disagreed with RFMR, Mar 12, 2010. through Jan 18, 2010., and adjudicated the judgment for the Public Works, that the project itself and proceedings of RFMR of the Republic of Korea is lawful, that it is estimated to be favorable to the environment of water, sea, atmosphere, soil, ecology of nature, living and socio-economic system, helpful to control water, flood, drought, water resources, water quality and valley inundation, and that it could avoid physical harm to historical remains.
The statement, quoting the above part of the Article 48, did not quoted the other part which one had better quote for mature discernment.
There is another text of the same ¡°Article 48,¡± as follows; ¡°In nature, the believer recognizes the wonderful result of God's creative activity, which we may use responsibly to satisfy our legitimate needs, material or otherwise, while respecting the intrinsic balance of creation. If this vision is lost, we end up either considering nature an untouchable taboo or, on the contrary, abusing it. Neither attitude is consonant with the Christian vision of nature as the fruit of God's creation.¡±
4 His Eminence Nicholas Cardinal Cheong, Archbishop and the Ordinary of Seoul Archdiocese, has settled the issue,
by historically just and legitimate judgment out of pastoral care, and has given the Korean faithful the peace of conscience.
His Eminence has clarified that ¡°the faithful could support to or dissent from Public Works for Restoration of Four Major Rivers of the Republic of Korea, as long as abiding by the principle of protection of environment.¡±(Evidence 8. 9. 10. 12.)
5 Most Rev. Peter KANG, president of CCK, shall not issue any statement, nor deliver any speech nor any act
in the name of all the Bishops of Korea, against the teaching authority ofHis Eminence Nicholas Cardinal Cheong, Archbishop and the Ordinary of Seoul Archdiocese, with regard to this issue. (CDIC can.455.)
The above statement of CCK against the Korean Public Works was the casewhich ¡°neither the universal law nor a special mandate of the Apostolic See gives the Episcopal Conference the power¡± to actwith.
The teachings of the faithful,during and after the above statement, by the President of CCK with regard to this issue have conflicted with the teachings by Magisterium of the respective Ordinarysincluding Archbishop and the Ordinary of Seoul Archdiocese (Annex A)(Evidence 10. 12. 18), constituted a transgression of CDIC can.455. section 4., and therefore are invalid.
We, the faithful, do cordially request Most. Rev. Petrus KANG, the President of CCK, to revoke the erroneous act without delay.
6 About Petitioners;
On Dec 21, 2010. 7 days after the twice repeated perpetration, we(some of Annex B)did cordially requested some of reproof, and imposition of penalty, in case of no avail, on the perpetrators who are the priests, member of so-called CPAJ, by notice of newspaper advertisement in name of ¡®14 faithful of same opinion¡¯(evidenc 13.)
After wait, we ¡®the Catholic Faithful for Defence of Magisterium¡¯(Annex B) have prepared 1st Petition and put up notice in newspaper advertisement on Jan 18, 2011.(Evidence 14.), requesting to sign the Petition and Power of Attorneyof the like-minded faithful. On this notice, the faithful who signed and sent them by mail, facsimile or e-mail(Annex C)(Evidence 15) numbered 2,106people and by internet sign(Annex D)(Evidence 16) numbered 1,286 people.

We ¡®the Catholic Faithful for Defence of Magisterium¡¯ have prepared another 2nd Petition and put up notice in newspaper advertisement on Feb9, 2011.(Evidence 21. 22), requesting again to sign the Petition and Power of Attorney. On this notice, the faithful who signed and sent them by mail, facsimile or e-mail (Annex E)(Evidence 32) numbered 1,648 people and by internet sign (Annex F)(Evidence 33) numbered 1,348 people.

7 Jurisdiction over Defendants and their addresses
As the said Contempt for Superior,Incitement to animosity and disobedience to Superior, and Denunciation of Superior of Dec 10, and 13, 2010., were perpetrated in Seoul City, an area of Seoul Archdiocese, the Tribunal of the Catholic Archdiocese of Seoul has jurisdiction over Defendants.
Since Defendants belong to the respective Dioceses or Archdioceses, Petitioners substitute the above mentioned Dioceses or Archdioceses for each Defendant¡¯s address
8 About anonymous priests of perpetration
The priests, who perpetrated on Dec 13, 2010., signed their names on the statement and made public(evidence 4. 5.)
Another priests have conspired anonymously to write the statement on Dec 10, 2010.(evidence 2. 3.), or consented to it. They are required to be traced and confirmed, for certain priests of the illegal organization as CPAJ have been usually leading activist movements anonymously with the name shield of the organization.

On June 14, 2010., at the Catholic Church in YangsuriYangpyeong County
Kyunggi Province Korea, Most Rev. Peter KANG (president of CCK, Bishop of Cheju Diocese) declared, during ¡®Life and Peace Mass to Obstruct the Four Major Rivers Project¡¯, that ¡°the opinion of the statement of CCK againstthe Korean Public Works on the Restoration of Four Major Rivers was told and issued by the Bishops. Since Bishops are authoritative scholars and teachers with regard to faith, every Catholic faithful should obey and follow the opinion.¡±
He continued to affirm that, ¡°Anyone who is the Cathlic faithful is not allowed to argue with or dissent from the opinion.¡±(evidence 10. 12. 18)
